Diane
and Lana evaluate each child’s educational needs during the free,
initial consultation. During your free consultation, you and the attorneys
can decide what legal needs your child may have. Diane and Lana will then
help guide you through the legal maze of education law, via one of their
four service models.
It is common for
a family to move between two or more service models as the child's educational
needs evolve. For example, Diane and Lana frequently start with a child
in the Direct Intervention Model and then later shift to the Maintenance
Model when the student's educational needs are being met and the educational
program is stabilized. Some families, over the years, have used each of
the service models available. Diane and Lana are committed to providing
the service model that best fits your child's individual educational needs.
EDUCATION LAW SERVICE MODELS
Confidential Consultative Model
This model works
best when a parent needs basic legal information and support regarding
the child's educational needs. Under this model, Diane and Lana do not
attend any meetings at the school or consult directly with District personnel.
Diane and Lana advise the parent(s) "in the background" by reviewing
documents, assisting in preparation for meetings, providing advice regarding
the law, or answering parent questions about the child's education.
Open Consultative Model
This model is used
when a parent wants legal assistance, but doesn't need an attorney to
attend meetings or draft correspondence. Under this approach, District
personnel are advised that Diane and Lana represent the student but that
the attorneys will not attend meetings. Typically, Diane or Lana will
talk to District personnel regarding your child's educational issues to
ensure that the process is followed properly and that the child’s
educational needs are addressed.
Direct Intervention Model
This approach is
used when the child's educational process needs direct involvement from
the attorneys. Under the Direct Intervention approach, Diane and Lana
attend meetings, talk to District personnel, negotiate settlements, participate
in Complaints or requests for Due Process Hearings with the Oregon Department
of Education, attend expulsion hearings, and consult with parents on all
issues relating to the child's education. Many parents start legal representation
with Diane and Lana under the Direct Intervention Model, then later shift
to the Maintenance Model.
Maintenance Model
The Maintenance Model
works best when a child's educational program is appropriate and running
smoothly. Typically, Diane and Lana prepare parents for meetings. They
also attend IEP meetings yearly to ensure the student's program continues
to serve the student's individual needs. Diane and Lana also consult with
parents regarding potential future issues and assist throughout the school
year on an as-needed basis. |
